Overview

A few months before trial, an electronics manufacturer hired MBS to defend it in a federal lawsuit in Houston by a customer alleging that video recorders it purchased for use in mass transit buses were defective. The lawsuit alleged breach-of-contract, breach-of-warranty, Texas DTPA, fraudulent nondisclosure, and declaratory-judgment claims and sought nearly $10 million in compensatory damages, plus punitive damages. Following MBS’s motion, the district court granted a partial summary judgment that eliminated claims and slashed the plaintiff’s damages model. Shortly thereafter, the case settled favorably to MBS’s client.
